1. Agreement to Terms

By accessing or using the services provided by Digital Priyanshu (“Service Provider,” “we,” “us,” or “our”), you agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, please do not use our services.

2. Services

We provide digital services including but not limited to:

  • WordPress website design and development
  • Sales funnel building and email automation
  • Facebook advertising campaign management
  • Related digital marketing and consulting services

3. Project Engagement

All projects will be governed by a separate project proposal or agreement that outlines:

  • Scope of work and deliverables
  • Timeline and milestones
  • Pricing and payment terms
  • Revision policy
  • Responsibilities of both parties

4. Payment Terms

  • Payment terms will be specified in the project proposal.
  • A non-refundable advance payment may be required to commence work.
  • Payments can be made through Razorpay, Instamojo, Cashfree, or bank transfer.
  • All prices are in Indian Rupees (INR) unless otherwise specified.
  • GST or applicable taxes will be added as per government regulations.

5. Client Responsibilities

As a client, you agree to:

  • Provide accurate and complete information required for the project
  • Provide timely feedback and approvals at project milestones
  • Ensure you have the rights to any content, images, or materials provided
  • Make payments as per the agreed schedule
  • Not share login credentials or access provided for the project with unauthorized parties

6. Intellectual Property

  • Upon full payment, you will own the final deliverables created specifically for your project.
  • We retain the right to showcase the work in our portfolio unless agreed otherwise.
  • Third-party elements (themes, plugins, stock images) remain subject to their respective licenses.
  • Source files, proprietary tools, and methodologies remain our intellectual property.

7. Revisions and Changes

  • The number of revisions included will be specified in the project proposal.
  • Additional revisions beyond the agreed scope may incur extra charges.
  • Major scope changes after project commencement may require a revised proposal.

8. Project Delays

While we strive to meet all deadlines, delays may occur due to factors beyond our control. Similarly, client delays in providing materials or feedback may impact project timelines. We will communicate proactively about any anticipated delays.

9. Limitation of Liability

  • We do not guarantee specific business results, sales, or outcomes from our services.
  • We are not liable for any indirect, incidental, or consequential damages.
  • Our total liability shall not exceed the amount paid for the specific service in question.
  • We are not responsible for third-party service disruptions (hosting, payment gateways, ad platforms).

10. Confidentiality

Both parties agree to maintain confidentiality of proprietary information shared during the project engagement. This includes business strategies, customer data, and other sensitive information.

11. Termination

Either party may terminate the engagement with written notice. In case of termination, payment will be due for work completed up to that point. Refer to our Refund Policy for details on refunds.

12. Governing Law

These terms shall be governed by and construed in accordance with the laws of India. Any disputes arising shall be subject to the exclusive jurisdiction of the courts in India.

13. Changes to Terms

We reserve the right to update these Terms and Conditions at any time. Continued use of our services after changes constitutes acceptance of the modified terms.
